Grand Jury indictments returned

After a recent session of the Ottawa County Grand Jury, indictments have now been returned against the following individuals, according to Prosecuting Attorney Mark Mulligan:

Richard A. McLaughlin, 52, and Karen D. McLaughlin, 57, both of 3925 E. Kirk Road, Port Clinton, have both been indicted on two counts of Theft. According to reports of the Ottawa County Sheriff's Office, the pair took over $25,000.00 from an elderly person during a three year period from 2003 through 2006. The amounts along with the specification of an elderly victim, takes all of the charges felonies of the second degree.

Marcelina L. Rivera also known as Marcey L. Rivera, 42, 114 W. Main Street, Oak Harbor, was indicted on two counts each of Passing Bad Cheeks and Theft by Deception, all felonies of the fifth degree, after she reportedly passed two bad checks for over $500.00 each in June 2007.

David L. Butts, 44, 3878 E. State Road, Port Clinton, has been charged with two counts of Criminal Nonsupport, both felonies of the fifth degree, after he allegedly failed to pay court ordered child support for his minor dependent from 2004 through 2006.

Michael A. Lacumsky, 21, 11638 Bloom Road, Oak Harbor, was indicted on one count of Gross Sexual Imposition and two counts of Importuning, all felonies of the fourth degrees along with five misdemeanor counts each of Contributing to the Delinquency of a Child and furnishing Alcohol to Underage Persons. The charges are the result of an incident earlier this year where Lacumsky allegedly purchased alcohol for a group of teens, then attempted to engage in sexual activity with a child under the age of sixteen.

Robin R. Masing, 53, whose last known address is 415 Harrison Street, Port Clinton, has been charged with one count of Failure to Appear, a felony of the fourth degree, after be allegedly failed to attend a hearing on a criminal case earlier this month.

Kyle A. Goetz, 19, whose last known address is 960 North Atwater Road, Oak Harbor, was charged with one count each of Theft and Receiving Stolen Property, both felonies of the fifth degree, one count of Identity Fraud, a felony of the fourth degree, and one misdemeanor count of Receiving Stolen Property. According to reports of the Ottawa County Sheriff's Office and the Carroll Township Police Department, Goetz allegedly took items from several individuals last month, including an ATM card, which he reportedly used on several occasions.

Gordon T. Stahl, 46, 22948 Walbridge East Road, Curtice, Ohio, was indicted on one count of Failure to Comply, a felony of the third degree, after he allegedly tried to flee from a sheriff's deputy who was trying to stop him for a traffic offense on July 26th.

Travis K Smith, 31, Newark, Ohio, has been charged with one count each of Felonious Assault and Aggravated Assault, felonies of the second and fourth degree, respectively. According to reports of the Port Clinton Police Department, Smith attacked a man at a Port Clinton bar earlier this month, causing serious head injuries.

Clayton Havens, 27,839 Maryland Street, Port Clinton, has been indicted on two counts of Ethnic Intimidation, after he reportedly committed crimes based on the race, color, religion, or national origin of the victim earlier this month. According to reports of the Port Clinton Police Department, Havens is allegedly responsible for committing Aggravated Menacing and Criminal Damaging against an individual outside a Port Clinton business on July 12th. Statements from witnesses indicate that the crimes were racially motivated. He is charged with a felony of the fifth degree and a misdemeanor of the first degree.

Roscoe Neff, 29, 2888 E. Fishack Road, Port Clinton, was indicted on one count each of Felonious Assault, a felony of the second degree, and Aggravated Assault, a felony of the fourth degree. He is accused of assaulting a man in Port Clinton earlier this month. The victim had to be flown to a Toledo hospital for treatment of his injuries.

Patrick M. Harris, 18, whose last known address is Oregon, Ohio, was indicted on two counts of Aggravated Arson, both felonies of the first degree, after he allegedly lit fire to items placed on the hood of a car last month in Harris Township. Two individuals were sleeping in the vehicle at the time of the incident.

Kenneth W. Mincer, 20, 3207 State Route 590, Elmore, has been charged with one count of Vandalism, a felony of the fourth degree, along with two misdemeanor counts of Assault and one misdemeanor count of Resisting Arrest. According to reports of the Elmore Police Department, officers arrested Mincer for the assault of two teens on July 21st. When he was placed in the back of the cruiser, Mincer reportedly kicked the door and window, breaking the 'window and damaging the door.

Summonses have been issued for Richard and Karen McLaughlin, Rivera, Butts, and Lacumsky. They are scheduled to make their initial appearances in the Ottawa County Court of Common Pleas on August 18, 2008. Warrants have been issued for all other defendants.

Mulligan noted that an indictment is merely a formal charge in the Common Pleas Court, and does not denote guilt or innocence
